Gift With Condition
DAILY FIQH
Question: A father says to his son, ‘I am giving you my car on the condition that I will use it in my life time and you will use it after my death”. What is the ruling?
Answer: If the son took possession of the car, he will become the owner of it. The condition by the father ‘ I will use it in my life’ is null and void. The car will belong entirely to the son, he can do with it as he pleases. The son may voluntarily give the car to his father to use.
